Domestic abuse and injunctions
Victims of domestic abuse can obtain protection by applying for an injunction (which tells another person what to do or not do), if they:
- Are, or were, married to or living with the abuser
- Are related to them
- Have agreed to marry them
- Have a child with them or share parental responsibility
- Are involved in the same family proceedings
Two main types of injunction are available:
- Non-Molestation Order: this prevents a person from pestering, threatening, attacking or harassing you.
- Occupation Order: this enables you to enter and remain in your home or restrict someone else from doing so. In harassment cases, this order can apply to a defined area close to your home.
Breach of a Non-Molestation Order is now an arrestable offence and, in consequence, can be a powerful weapon in serious cases of abuse.
